Privacy Policy

1. About this policy

Nokkturnal Games ("we", "us", "our") is an independent game developer based in Queensland, Australia. This policy explains how we handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and how we handle it for players outside Australia.

It covers this website and our games, game clients and related services (the "Games").

2. Information we collect from this website

Analytics

We use Cloudflare Web Analytics to understand how many people visit and which pages they read. It is privacy-focused: it does not use cookies, does not fingerprint visitors, and does not track you across other websites. It reports aggregated data such as page views, referrer, country, browser and device type. We cannot identify you from it.

Hosting and security logs

This site is hosted on Cloudflare Pages. Cloudflare processes technical request data, including IP addresses, to serve the site and to protect it from abuse. This is done by Cloudflare as our service provider under its own privacy terms.

Fonts

Our pages load typefaces from Google Fonts. When your browser requests those files, Google receives your IP address and browser details. We receive nothing from that request.

Email

If you email us, we receive your email address, your message, and anything you choose to include in it. We use that only to respond and to keep a record of the exchange.

Cookies

We do not set cookies on this website, and we do not run advertising or cross-site tracking.

3. Information we collect in our Games

Save data stays local

Your progress, settings and save files are written to your own device. We do not upload them and we cannot read them. If you use a storefront's cloud save feature, that storefront stores the file under its own terms.

Gameplay telemetry (opt-in)

Our Games can send anonymous gameplay statistics to help us balance difficulty and find broken systems. This is off by default. Nothing is sent unless you turn it on in the game's settings, and you can turn it off again at any time.

When it is enabled, a submission may include:

• a randomly generated install identifier, which is not linked to your name, email or storefront account;
• gameplay events and outcomes, such as run length, difficulty, income, upgrades purchased and how a run ended;
• the game version, build type, platform and which storefront the build came from; and
• basic performance information.

We do not collect your name, email address, storefront ID, contact list, location beyond coarse country, or the contents of your device.

Bug reports

If you submit a bug report from inside a Game, we receive it only after you confirm that specific submission. A report may include recent game log lines, your system specifications, and anything you type into the description field. Please do not include personal details you would rather not send.

4. Why we handle this information

• to operate, secure and improve this website and the Games;
• to diagnose crashes and fix bugs;
• to balance and design gameplay using aggregated statistics;
• to respond to your enquiries and support requests; and
• to meet our legal obligations.

Where the GDPR or UK GDPR applies to you, our lawful bases are your consent (for opt-in telemetry and bug reports) and our legitimate interests in running a secure website and improving our games.

5. Who we share it with

We do not sell personal information and we do not share it for advertising. We disclose information only to:

• service providers who host, deliver or protect the website and our telemetry infrastructure;
• storefronts and platforms you choose to use, such as Steam or itch.io, which collect their own data under their own policies and to which we have no special access;
• modding platforms, if you choose to use in-game mod features; and
• anyone else where you consent, or where we are required or authorised by law.

6. Overseas disclosure

Some of our service providers are located outside Australia, including in the United States and the European Union. By using this website or enabling telemetry, you acknowledge that your information may be handled overseas, and that overseas recipients may not be subject to the Privacy Act. We take reasonable steps to use reputable providers with appropriate protections.

7. Security and retention

We take reasonable steps to protect information from misuse, loss and unauthorised access, including transport encryption and restricted access to our systems. No method of transmission or storage is completely secure.

We keep aggregated telemetry for as long as it is useful for balancing and development. Bug reports are kept until the issue is resolved and verified. Email correspondence is kept while it remains relevant. We delete or de-identify information when we no longer need it.

8. Children

Our website and Games are not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, contact us and we will delete it.

9. Your rights

You may ask us to:

• confirm what personal information we hold about you;
• give you access to it;
• correct it if it is wrong; or
• delete it.

Email admin@nokkturnalgames.com and we will respond within a reasonable period, normally within 30 days. Because telemetry is tied to a random install ID and not to you, we may need that ID from your game's settings screen in order to locate or delete the matching records, and in some cases we may be unable to link any data to you at all.

If the GDPR or UK GDPR applies to you, you also have rights to restrict or object to processing, to data portability, to withdraw consent at any time, and to complain to your local supervisory authority. If you are a California resident, we confirm that we do not sell or share personal information as those terms are defined under the CCPA/CPRA.

10. Complaints

If you think we have mishandled your personal information, please contact us first at admin@nokkturnalgames.com so we can try to resolve it. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.

11. Changes to this policy

We may update this policy from time to time. The current version is always published at this address with the "last updated" date shown at the top. Where changes are significant, we will note them on this website.
